⚠️ Why This Matters
While data centers require a Special Use Permit in the new T District (providing some public oversight), significant concerns remain:
- Floating zone: Can be applied anywhere in the county — no designated areas
- No acreage cap: Unlimited cumulative data center development permitted
- Self-reported data: No independent metering for water/electric usage
- No penalties: Ordinance lacks enforcement mechanisms for non-compliance
Note: Data centers are currently permitted BY-RIGHT in the existing I-2 (General Industrial) district with no protections. The T District adds the SUP requirement.
